Employment discrimination laws have been enacted to protect against Age Discrimination in the United States. One such law is the The Age Discrimination in Employment Act of 1967 (ADEA), which protects individuals who are 40 years of age or older from employment discrimination on the basis of age.

Note: The aforementioned law ONLY pretains to persons over 40 years of age. If an employer does not hire somebody beacuse they are too young (under 40), it is not illegal. If an employer does not hire somebody beacuse they are too old, it is illegal.

The ADEA protects employees and job applicants. Under this law, it is unlawful to discriminate against a person because or his/her age with respect to any term, condition, or privilege of employment, including hiring, firing, promotion, layoff, compensation, benefits, job assignments, and training.

Forms of Age Discrimination

Under the Age Discrimination in Employment Act (ADEA), it is illegal to discriminate in any aspect of employment, including:

  • hiring and firing;
  • compensation, assignment, or classification of employees;
  • transfer, promotion, layoff, or recall;
  • job advertisements;
  • recruitment;
  • testing;
  • use of company facilities;
  • training and apprenticeship programs;
  • fringe benefits;
  • pay, retirement plans, and disability leave; or
  • other terms and conditions of employment.
