Law enforcement officers must abide by established guidelines when dealing with citizens and suspects. Our laws offer protection to you even though you may be charged with or suspected of a crime. However, law enforcement abuse of power can occur, resulting in violations of a person’s rights. While not all incidents involving an officer’s use of force to subdue or investigate a person give rise to a claim for civil damages, there are instances where citizens are treated physically in a manner that is shocking. For example, beating or tasing an innocent person, shooting someone who does not present a threat or using force in excess of the need under the circumstances, may be actionable in civil court.
