Employment discrimination laws have been enacted to protect against Sexual Discrimination in the United States. One such law is under Title VII of the Civil Rights Act of 1964, which protects individuals against employment discrimination on the basis of sex or gender.

Forms of Sexual Discrimination

Under the Civil Rights Act of 1964, it is illegal to discriminate in any aspect of employment, including:

  • hiring and firing;
  • compensation, assignment, or classification of employees;
  • transfer, promotion, layoff, or recall;
  • job advertisements;
  • recruitment;
  • testing;
  • use of company facilities;
  • training and apprenticeship programs;
  • fringe benefits;
  • pay, retirement plans, and disability leave; or
  • other terms and conditions of employment.

What is Sexual Discrimination?

Sexual discrimination occurs when an employer treats an employee or job applicant less favorably because because of his or her gender. Employment decisions based on stereotypes and assumptions about abilities, traits, or the performance of individuals on the basis of sex is also considered sexual discrimination.

Special Considerations

The following is a brief list of special considerations relating to sexual discrimination.

  • Sexual Harassment - You are protected against practices ranging from direct requests for sexual favors to workplace conditions that create a hostile environment for persons of either gender, including same sex harassment.
  • Pregnancy Based Discrimination - In another form of sexual discrimination and under the Pregnancy Discrimination Act, you are protected against discrimination on the basis of pregnancy, childbirth and related medical conditions.
  • Equal Pay - Under the Equal Pay Act of 1963, you are protected against compensation discrimination on the basis of sex.
  • Retaliation - You are protected and have a right to be free from retaliation for your opposition to discrimination or the participation in an EEOC proceeding by filing a charge, testifying, assisting, or otherwise participating in an agency proceeding.
